Securing sums in Gibraltar bankruptcy move unlikely

In its continuing efforts to enforce the judgement by which the Supreme Court made an award of damages in the sum of £6.3 million in January last year, lawyers acting for the Financial Services Commission (‘FSC’) have now obtained bankruptcy orders against two of the former directors of Rock Financial Services Limited (‘RFSL’).
In this latest action Anthony Everard Whitting and Michael James Gregory Whitting were declared bankrupt at the High Court and Chelmsford County Court respectively.
Rock Financial Services Limited has no connection with another Gibraltar investment firm, Rock Limited which operates from Watergardens, Gibraltar.
In a reaction from the FSC’s Chief Executive Officer, Marcus Killick, said: “Although the recent bankruptcies would indicate that there is a low likelihood of securing the sums awarded, the FSC is continuing to pursue this matter. Our message is clear, we will pursue wrongdoing of this kind relentlessly.”
