Voting: Serious legal problems could arise, says Government

Even though the Advocate General's opinion agrees with the UK/Gibraltar position (and thus disagrees with Spain) on all but one point, the Gibraltar Government does not agree with the Advocate General's opinion in respect of that one point, It remains to be seen whether the Court accepts the Advocate General's opinion and follows it, or not, said the Govt late yesterday
They add: The Advocate General has opined in favour of the Euro voting arrangements made by UK for Gibraltar, except that in his opinion non-British Commonwealth nationals should not have been allowed to vote in Gibraltar, even though they can vote in the UK, It is not acceptable to the Gibraltar Government that there should be qualitative discrimination as between what can happen in Gibraltar and what can happen in the UK.
Such a ruling would also appear to create serious legal problems, since not clear how the two parts of a Combined constituency, (which the Advocate General approves of) could have different voter eligibility rules, i.e Commonwealth citizens could vote in the South West of England part of the Constituency but not in the Gibraltar Part of the same Constituency; With respect to the Advocate General, it would appear that he has not sufficiently considered the ramifications of his opinion on that single point. Otherwise;the opinion is wholly favourable to Gibraltar.
