US court document seeks services of Gibraltar lawyers

A 5-page document is being presented to the US Bankruptcy Court, Southern District of New York, regarding Bernard Madoff and the appointment of Gibraltar lawyers.

The document says that issues have arisen overseas, and in Gibraltar in particular, that require the trustee's participation and representation by counsel. The Trustee has become aware of assets that he believes to be customer property located within that country and requires counsel to pursue such customer property.

"The Trustee, therefore, proposes to retain and employ the law firm of Attias & Levy as its special counsel with regard to its recovery of customer property in Gibraltar, and any related matters as directed by the Trustee, effective as of March 13, 2009."

The services of the Gibraltar lawyers are described as necessary and essential. Attias & Levy has indicated a willingness to act.

Says the document: There is reference to the best of the Trustee's knowledge, and except as disclosed in the declaration of disinterestedness of Keith Azopardi, executed on March 16, 2009,the members, counsel and associates of Attias & Levy are disinterested and do not hold or represent any interest adverse to the Debtor's estate in respect of the matter for which Attias & Levy is to be retained.

Attias & Levy will be compensated by their normal hourly rates, less a 10% discount. Their rates are stated as ?200 an hour for Partner and ?155-?175 an hour for Associate.
